I've always been prompted for a product key when performing an upgrade from a previous qualifying version of Windows.
I've always just chosen skip or do this later or I don't have a product key and continued with the upgrade. Assuming that the previous version was activated and genuine, I've never had a subsequent problem with Windows 10 activating
I noticed that with the latest ISO, the two previous prompts have been eliminated where you could choose skip and or do this later and only the I don't have a product key seems to remain.

I have a legal copy of windows starter, and upgraded to home premium by following some internet procedures. Home premium is up and running, but it is asking for a win 10 key. could it be the premium is not legal.

That may be.... I have no idea how or what procedure you used, to upgrade from Starter to Premium.
Why didn't you just upgrade from Starter to 10, I'm pretty sure you would have ended up with 10 Home version anyway.

Cool, you have Windows 10 and will receive no updates because it is not activated. Sounds OK to me. Just ignore the annoying Not a valid copy banner on your screen. What is it you see there anyway? Upload a snip/screenshot.
